NEW Mein Schiff 1, Far East

Bangkok and Vietnam and many more? A long flight then off we went. Or we didn`t as the ship's transformers caught fire and we had to travel at a reduced speed meaning we wouldn't be able to go to three of the countries we had hoped to visit. TUI in their arrogance decided to appease everyone on board with the sum of £250 each to shut us up. Not to be. Singapore twice and Kulala Lumpa twice with a few other exotic places in between but many missed. I got my mad up.......
CLAIM NUMBER 232***
A response for the court to the defendants (TUI) defence.
I am asking for the court to be patient with us if we are going about this in the wrong order, this is new to us.Tui have high powered expensive clever legal representatives and we have me.
We were at dinner when the fire alarm went off and of course everyone was worried. A fire onboard whilst at sea! Tui states the issue was resolved. That statement fails to describe the fear that permeated around the ship at that time. We had to rely on the captain keeping us up to date and he did.The itinerary was to be cut.As soon as we heard that we were upset, spending a lot of money only to be told your dreams are shattered, that's how strong we felt about the situation and more so when it was revealed by other passengers on board with us that the same thing happened to them a year ago,on the same ship, a fire in the transformer room with the resultant failure to complete the advertised itinerary. They received 50% of their booking cost, we were told. In our opinion TUI were wrong to still take bookings from unsuspecting passengers knowing full well the fire history of that particular ship. And history did repeat itself. The transformer fault was not repaired properly, it couldn't have been as it went up in smoke again and so the ship should not have been at sea. It would be interesting to find out how many people were reimbursed the first time if TUI would like to comment.
The itinerary was cut drastically to the extent we would NEVER have booked the cruise with the itinerary that was left, simply visiting the same places twice, on the way there and on the way back. Four days at sea instead of two.
We did NOT receive £250 each. I wrote to TUI telling them I would accept their offer of £250 each but was ignored. Eventually, Tui replied, telling me I will not get a penny and the matter is closed. Well, the matter is not closed and the court should be made aware of their arrogant reply. We had no choice but to instigate court proceedings.
BBC`s flagship program, Rip Off Britain, on 14th June 2021 featured a Mr. Russel Clarke who took Tui to court and Tui paid out before it went to court. I have a transcript. Mr Clarke was on the same ship as we were on. How can Tui differentiate between his case and ours? He goes on to say that the cruise he was left with was not one he would have paid for and the experience fell short of his expectations with the cruise ruined. It was more like a ferry crossing he said,
The Package Travel Regulations 2018 states “if a significant portion of the trip cannot be provided the tour operator must provide an appropriate price reduction.” £250 does not come close. Tui knows this and states, after the bad news
was put out, along with the fire, that `We understand that this isn't the cruise experience you booked`....They got that bit right.
That was my case that was put before the court as TUI ignored my complaint for two years and yes I won.......£2811.00 plus costs, I still had trouble getting it from them until I instructed the Bailiffs to wheelclamp one of their boeing aeroplanes at Luton airport. They soon paid up........
